1. Acceptance of these terms
These Terms of Use (“Terms”) are an agreement between you and the Moon Moose team (“Moon Moose,” “we,” “us,” or “our”). They apply to the Moon Moose website and related pages that link to these Terms (together, the “Site”).
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. If you use the Site on behalf of an organisation, you confirm that you have authority to bind that organisation.
2. Eligibility
You must be at least 13 years old to use interactive parts of the Site. If the law where you live requires a higher minimum age, that higher age applies. If you are under the age of legal majority where you live, a parent or legal guardian must review these Terms with you and permit your use.
You may not use the Site if doing so would violate applicable law, sanctions, export controls, or a binding restriction that applies to you.
3. Moon Passport
A Moon Passport is a playful, numbered early-participant card connected to the Moon Moose story. Unless we clearly state otherwise for a future feature, it is not a non-fungible token (NFT), cryptocurrency, security, financial product, government identity document, ticket, ownership certificate, or proof of residence or citizenship.
A passport number has no promised monetary value. It does not grant ownership of Moon Moose intellectual property, equity, voting power, guaranteed access, an allocation of digital assets, or a right to future rewards. Project plans may evolve, and no statement on the Site is a promise that a future product, collection, token, game, event, or benefit will launch.
You are responsible for keeping access to your connected account secure. Moon Moose may reject, merge, renumber, or cancel duplicate, automated, fraudulent, or abusive registrations when reasonably necessary to protect the experience.
4. Your conduct
You agree not to:
- break any law or infringe another person’s rights;
- impersonate another person or misrepresent an affiliation;
- submit malware, harmful code, spam, or deceptive material;
- interfere with the Site, bypass access or security controls, or probe for vulnerabilities without written permission;
- automate registrations, scrape the Site at a disruptive rate, or manipulate passport numbering;
- use Moon Moose names, artwork, or branding to suggest an unauthorised sale, partnership, endorsement, or official account; or
- harass, threaten, exploit, or harm other people.
We may limit access, discard abusive or duplicate submissions, and take reasonable steps to protect the Site and community.
5. Project content and ownership
The Site and its stories, characters, names, artwork, illustrations, animation, design, text, software, logos, and other materials are owned by Moon Moose or its licensors and are protected by intellectual property laws.
We give you a limited, personal, non-exclusive, non-transferable, revocable licence to access the Site for lawful, non-commercial use. These Terms do not transfer any ownership rights. You may not copy, sell, mint, tokenise, merchandise, modify, distribute, or commercially exploit project content without prior written permission, except where applicable law expressly allows it.
6. Your submissions and feedback
You keep any ownership rights you already have in content you submit. You give Moon Moose a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt, and display that content only as reasonably needed to operate, secure, improve, and promote the relevant Site feature. This licence ends when the content is deleted from our active systems, except for backups, legal records, and material already shared with your permission.
You confirm that you have the necessary rights to anything you submit. General ideas and feedback may be used without payment or obligation to you, but we will not treat personal information as public merely because it accompanied feedback.
7. Third-party services
The Site may link to or mention X, Instagram, Solana, wallets, marketplaces, or other third-party services. They are governed by their own terms and privacy policies. Moon Moose does not control and is not responsible for third-party content, availability, security, transactions, or conduct.
A link or reference does not imply sponsorship, endorsement, or partnership. Moon Moose will never ask for your wallet seed phrase or private key. Treat accounts, mints, tokens, or payment requests claiming to be Moon Moose as suspicious unless they are confirmed through our official channels.
If you connect a social account, you authorise us to use the permissions shown during that connection to authenticate you and provide the feature you request. We will publish a Moon Passport or related post to your account only after you take a clear sharing action. You may disconnect Moon Moose through the relevant third-party account settings.
8. No financial or professional advice
Nothing on the Site is financial, investment, tax, legal, or other professional advice, or an offer to buy or sell any asset. References to blockchains, digital collectibles, or community experiments are informational and creative. You are responsible for your own decisions and for obtaining independent advice when appropriate.
9. Availability and changes
The Site is an evolving creative project. We may add, change, pause, or remove content and features at any time. We do not guarantee that the Site, a passport number, or any feature will always be available, error-free, or preserved. We may also update these Terms by posting a revised version and changing the effective date.
10. Disclaimers
To the maximum extent permitted by law, the Site is provided “as is” and “as available.” Moon Moose disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or secure operation. We do not warrant that content is complete, that errors will be corrected, or that the Site is free from harmful components.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you. Nothing in these Terms removes consumer rights that cannot legally be waived.
11. Limitation of liability
To the maximum extent permitted by law, Moon Moose and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or digital assets, arising from or related to the Site.
Where liability cannot be excluded, our total liability for claims relating to the Site will not exceed the greater of the amount you paid directly to Moon Moose for the relevant Site service during the six months before the claim or USD 100. These limits do not apply where prohibited by law, including to liability that cannot legally be limited.
If a dispute arises, please contact us first so we can try to resolve it informally. These Terms are governed by the law that applies to the Moon Moose operator, without overriding mandatory consumer protections or rights you have in your home country. Courts with lawful jurisdiction may hear unresolved disputes.
